Terms of Service

Welcome to Courtesies, a mobile application operated by Courtesy LLC ("Company," "we," "us," or "our"). By using Courtesies (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. Privacy

2. Eligibility

You must be at least 13 years old to access and use the Service. If you are between the ages of 13 and 18 years old, you may use and access the Service only under the supervision of your parent or guardian who has agreed to be bound by these Terms. The Service is not available to any Users previously removed from the Service by us.

3. Accounts and Security

You may register using your email and password or via Single Sign-On (SSO) with Google or Apple. You are responsible for maintaining the confidentiality of your account credentials. Any activity occurring under your account is your responsibility. Notify us immediately of any unauthorized access. You agree to provide accurate, current, and complete information and to keep your account information updated. We are not liable for any loss or damage arising from your failure to comply with these obligations.

4. Consent to Notifications

By creating an account, you consent to receive communications from us, including via email, SMS, and push notifications. These communications may include updates about the App, reminders for events, security alerts, and promotional offers. You can manage your notification preferences in the App settings; however, certain service-related notifications may be required.

5. Services Provided

The App provides tools for managing relationships and gift-giving for children. By using the App, you acknowledge and agree that:

  • The App is provided for personal, non-commercial use only.
  • You may store and manage contact details, including names, birthdays, and preferences, subject to our Privacy Policy.
  • Any gift recommendations provided are for informational purposes only, and we do not guarantee availability, pricing, or suitability of suggested gifts.
  • We do not endorse or receive compensation from any brands or third-party vendors listed within the App.
  • You are solely responsible for verifying the accuracy of any information entered into the App.
  • The App may require permissions to access device features such as contacts and photos for enhanced functionality. Granting such permissions is voluntary, and you may modify them in your device settings.
  • Enabling push notifications constitutes consent to receive reminders and updates relevant to your use of the App.
  • We reserve the right to modify, suspend, or discontinue any features of the App at our sole discretion, without prior notice or liability.

6. User Conduct

You agree not to:

  • Use the App for fraudulent, deceptive, or unlawful purposes.
  • Interfere with or disrupt the App’s functionality, servers, or networks.
  • Upload harmful, offensive, or unauthorized content.
  • Attempt to gain unauthorized access to another user’s account or data.

Failure to comply with these provisions may result in suspension or termination of your account.

7. User Content

You may have the opportunity to create, submit, post, or share content through the App. You retain ownership of any intellectual property rights that you hold in that content. By submitting content, you grant Courtesy LLC a worldwide, non-exclusive, royalty-free, transferable license to use, copy, modify, distribute, and display such content in connection with operating and providing the App services. You are responsible for ensuring that any content you submit does not violate third-party rights or applicable laws.

8. Payments and Transactions

Certain features of the App may require payment. All transactions are final and subject to third-party payment processor terms. You agree to provide accurate and complete payment information and authorize us to charge your payment method for any purchases made through the App. We are not responsible for unauthorized transactions or issues arising from third-party payment services.

9. Intellectual Property Rights

All rights, title, and interest in and to the App, including all related software, technology, and content, are owned by Courtesy LLC or its licensors. Unauthorized use, reproduction, distribution, or modification of the App’s content is strictly prohibited.

10. Termination

We may suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time, but certain data may be retained as required by law or for legitimate business purposes.

11. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, COURTESY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR USE OR INABILITY TO USE THE APP; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (III) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE APP; OR (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE APP BY ANY THIRD PARTY.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in Masschussets, in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action. If arbitration is found unenforceable, disputes shall be resolved exclusively in the state and federal courts of Masschussets.

14. Changes to These Terms

We may update these Terms from time to time. Any modifications will be effective immediately upon posting. Continued use of the App after such changes constitutes acceptance of the new Terms.
